By accessing or using osmTalk's services, you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Services

osmTalk provides AI-powered voice agent services for businesses, including automated call handling, appointment scheduling, lead qualification, and customer support. Services are provided on a subscription basis.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. You are responsible for all activity under your account.

4. Acceptable Use

You agree not to use our services for any unlawful purpose, to impersonate others, to transmit harmful content, or to interfere with the operation of our platform. AI agents must not be used to deceive callers about their non-human nature where required by law.

5. Intellectual Property

osmTalk retains all rights to its platform, technology, and branding. You retain ownership of your data and custom configurations. You grant us a limited license to process your data as necessary to provide our services.

6. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any downtime or service interruptions. Scheduled maintenance will be communicated in advance.

8. Limitation of Liability

To the maximum extent permitted by law, osmTalk shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

9. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the platform will cease and your data will be available for export for 30 days.

10. Governing Law

These terms are governed by the laws of the jurisdiction in which osmTalk operates. Any disputes shall be resolved through binding arbitration.
